Information about AI Note Taking Tools

Your clinician at Two Chairs has access to Upheal, an automated AI note-taking tool. This tool uses AI to generate notes, a required form of clinical documentation for your medical records. Upheal helps your clinician summarize and understand your discussions, so they can spend less time on paperwork and focus on giving you better care.

Here, we'll explain how the AI tool works. We'll also cover how Two Chairs and Upheal protect private health information (like your medical records) and personal details (like your name and email). We follow laws including HIPAA to keep your information safe. Your consent starts when you agree to it and ends whenever you choose to update your consent preferences.

What information do we use and why?

With your permission, Two Chairs and Upheal collect and use the following types of data:

  • Health Information (PHI): The AI tool processes PHI to accurately transcribe and generate documentation for sessions. This includes any health data, habits, or lifestyle information you mention during a session.
  • Personal Information (PII): We might use the AI tool to record sessions and create user profiles, which could include your name, contact information, date of birth, and gender.
  • Recordings: The AI tool uses a session recording to generate a transcript. Once the transcript is created, the audio is permanently deleted. In the event that the audio recording doesn’t become a transcript, Upheal may store the audio for a short period of time in order to create the transcript — which then generates notes.
  • Transcripts: The AI tool generates a transcript from session recordings in order to create notes, and deletes the transcripts as soon as notes are created.
  • Usage Data (no personal or health information): Two Chairs uses this data to improve your experience and may share it with Upheal to help them improve their technology.

How long does Two Chairs and Upheal keep your data?

Session Data, PHI, PII, and Recordings: As soon as notes are created, the audio and transcript are deleted. In the event that a recording or transcript does not automatically become a note, the audio or transcript may be stored for a short period of time until the note is created.

All notes created by Upheal are reviewed by a licensed, human clinician. Neither Two Chairs nor your clinician will use Upheal to make decisions about your care.

What are your rights regarding your data?

You have rights concerning your health information, including:

  • Obtaining a copy of your Medical Record at any time. This right does not apply to the psychotherapy notes written by Two Chairs clinicians inside or outside of Upheal.
  • Correcting or amending your PHI.
  • Restricting what PHI we use or share.
  • Knowing who we have shared your PHI with.
  • Requesting a particular way of receiving confidential communications from us.
  • Receiving a paper copy of this Notice of Privacy Practices.
  • Filing a complaint. You may contact the Office for Civil Rights at the US Department of Health and Human Services directly. Filing a complaint will not impact your access to care or the quality of care you receive.

Your PHI and PII are processed within the United States by Two Chairs and its vendors including Upheal.
