Informed Consent for Treatment in Florida

General Information

The therapeutic relationship is unique because it is highly personal. At the same time, it’s a contractual agreement. Therefore it is important to reach a clear understanding about how the relationship will work, and what each party can expect. The purpose of this informed consent is to  provide a clear framework for our work together, and to obtain your informed consent to receive telehealth services from Two Chairs clinicians and/or prescribers. Content related to therapy will only be applicable if enrolled in therapy services; content related to psychiatry will only be applicable if enrolled in psychiatry services. Feel free to discuss any of this with your clinician.

Two Chairs Informed Consent for Treatment, Two Chairs, Notice of Privacy Practices, Two Chairs Practice Policies, apply to both in-office and teletherapy services, regardless of modality.

You are not permitted to record a session without dual consent. This includes, but is not limited to, audio recordings, video recordings, and artificial intelligence (AI) tools for capturing and processing content. Any attempt to do so may result in the immediate ending of your session.

The Process

You have taken a very positive step by deciding to seek support for your mental health. The outcome of treatment depends largely on your willingness to engage in this process. While treatment offers benefits like reduced distress, improved relationships, greater self-awareness, and better stress management, sometimes, the process may result in considerable discomfort. Remembering unpleasant events and becoming aware of feelings attached to those events can bring on strong feelings of anger, depression, anxiety, etc. There are no miracle cures. Two Chairs cannot promise that your behavior or circumstances will change. Two Chairs can promise to support you and do our very best to understand you and your repeating patterns, and help you clarify what it is you want for yourself.

Confidentiality

The session content and all relevant materials to your treatment will be kept confidential unless you request in writing to have all or portions of session content released to specifically named person(s). 

Limitations of such client held privilege of confidentiality exist and are listed below:

  1. If a client threatens or attempts suicide or otherwise conducts him/her self in a manner in which there is a substantial risk of incurring serious bodily harm.
  2. If a client threatens grave bodily harm or death to another person.
  3. Clinicians are mandated reporters and must report for legal or ethical reasons. This includes suspected child abuse or neglect or suspected abuse or neglect of elders and dependent adults. Suspected abuse includes, but is not limited to, physical, emotional, sexual, or financial abuses. Reporting requirements vary by state. If you have questions regarding the mandatory reporting statutes for your state, please speak with your clinician.
  4. If a court of law issues a legitimate subpoena for information stated on the subpoena.
  5. If a client is in therapy or being treated by order of a court of law, or if information is obtained for the purpose of rendering an expert’s report to an attorney.

Occasionally, your clinician may need to speak with other professionals in order to provide the best treatment for you. These consultations may occur internally within Two Chairs or externally with providers outside the organization, depending on the circumstances.

  1. Internal communications: Two Chairs clinicians who are currently providing health care to you for the purpose of diagnosis or treatment, or who have previously provided treatment to you, may share relevant information, to the extent that the records pertain to the provided treatment, and to collaborate and coordinate care, as permitted under HIPAA and state law.
  2. External communications: Two Chairs clinicians may need to speak with other professionals in their areas of expertise in order to provide the best treatment for you. Information about you may be shared in this context without using your name or other personal identifying information (PII). Disclosure of any PII or release of records will require your written consent via a Release of Information (ROI) form.  You understand and agree that Two Chairs will coordinate care with the provider who referred you to Two Chairs and may share information relating to your treatment at Two Chairs as permitted under HIPAA and state law and this document acts as consent for the sharing of such information.

If you and your clinician see each other accidentally outside of your sessions , they will not acknowledge you first. Your right to privacy and confidentiality is extremely important to Two Chairs, and we do not wish to risk your privacy. However, if you acknowledge your clinician first, they will be more than happy to speak briefly with you. But, it would not be appropriate to engage in any lengthy discussions in public or outside of your sessions.

Services

Two Chairs offers two types of services: therapy and psychiatry. These sections describe these services in more detail.

1. Therapy

Two Chairs offers Therapy services. If you request therapy services with Two Chairs, the first step in starting is a virtual matching appointment with a licensed matching expert. This is a 45 minute session with the goal of gathering a brief overview of what brings you to therapy, understand current symptoms and stressors you might be experiencing, and discuss your goals for treatment, as well as any preferences you have about your matched clinician. After your appointment, you will be matched with an ongoing clinician and you will be able to view a bio of your clinicians professional qualifications that will include:

  1. Your clinician’s name, type of license or registration, and the license and state registration number.
  2. Your clinician’s education and experience
  3. Your clinician’s modalities and specialties

Potential Risks

  • May cause you to experience uncomfortable or unpleasant feelings.
  • Symptoms may worsen before improving.

2. Psychiatry

Two Chairs offers Psychiatry services. If you request psychiatry services with Two Chairs, these two sections apply. The first step in starting is a virtual evaluation appointment with a licensed clinician. After your appointment, your clinician will determine if you need further evaluation or if you can begin treatment. Psychiatry clinicians may order medical and psychological tests to assess your physical and mental health. Treatment options may include psychotherapy, medication, and psychosocial interventions, tailored to your needs. Your clinician will determine your treatment plan and the frequency of your visits.

In accordance with Florida Statute 458.348 (4), when you are referred to our office by another practitioner, you have the right to be informed of the type of license held by our clinicians who will be providing services to you. Two Chairs uses advanced professional practitioners for the provision of psychiatry services, which include advanced practice nurse practitioners (APRN) and physician’s assistants (PA). You recognize and acknowledge that your clinician will likely be an advanced professional practitioner such as an advanced practice nurse practitioner or a physician assistant overseen by a supervising psychiatrist, and agree to receiving these services.

Prescribing

When your mental health markedly impacts your ability to work, maintain interpersonal relationships, or properly care for your basic needs, medication may offer much needed relief. If enrolled in the Psychiatry program and recommended for medications, your clinician will explain all necessary information regarding the potential side effects, drug interactions, and proper usage. You agree to follow the directions of the clinician and consent to the risks associated with any prescribed medication.

Your clinician may also recommend prescribing medications for off-label use, where appropriate.  In these instances, the clinician will discuss the potential risks and benefits of this approach as well as discuss alternative treatment options.

Not everyone is a good candidate for medication therapy. Such therapy requires strict adherence to dosage, and frequency, close follow-up, and sometimes regular blood tests. Your ability to adhere to medication treatment will be taken into consideration in making the decision to start such therapy. You understand and acknowledge that there are inherent risks and side effects in taking certain medications.

Telehealth

Telehealth is the provision of health services provided digitally. This typically happens via secure, HIPAA-compliant, video conference. Telehealth offers a highly effective option to continue care when in-person care is not possible or not preferred. You are not required to receive services via telehealth.

  • Easier access to care; easier to continue care.

Potential Risks of Telehealth

  • Interruptions, background noise, or technical difficulties.
  • Unauthorized access to your health information if you are not in a private room or location.
  • If there is a crisis during your session, your clinician will not be in the same location as you.

Electronic Communications

As part of receiving services from Two Chairs, we may send you various communications related to your care.  These communications may include information on getting started with your care, appointment reminders, administrative messages, and other service-related messages. You agree and consent to electronic forms of communication, including but not limited to: (1) emails to the address you provided during sign-up; (2) text messages to the mobile number you provided during sign-up; and through the Two Chairs Client App.  For additional information please refer to our Electronic Terms of Service Policy.

State Appendix

Licensed professionals practicing therapy for a fee must be credentialed with the appropriate state licensing board for the protection of the public health and safety. Credentialing of an individual with the state licensing board does not include recognition of any practice standards, nor does it imply the effectiveness of any treatment.

Complaints against licensees, registrants, and certificate holders should be submitted to the appropriate state board. Complaints must be submitted in writing, either by mail or electronically through the board's online complaint form, if available.
